Disgorgement of profits is not exactly a household word in private law. Particularly in civil law jurisdictions – as opposed to those of the common law – the notion is not well known. What does it stand for? It is best illustrated by examples. One of the best known being the British case of Blake v Attorney General,  1 AC 268. In which a double spy had been imprisoned by the UK government before escaping and settling in the former Soviet Union. While there wrote a book on his experiences, upon which the UK government claimed the proceeds of the book. The House of Lords, as it then was, allowed the claim on the basis of Blake’s breach of his employment contract. Other examples are the infringement of intellectual property rights, where the damages of the owner are limited, but the profits of the wrongdoer immense. In such cases, the question arises whether the infringing party should be disgorged of his profits.
This volume aims at establishing the notion of disgorgement of profits as a keyword in the discourse of private law. It does not purport to answer the question whether or not such damages should or should not be awarded. It does however aim to contribute to the discussion, the arguments in favour and against, and the organisation of the various actions.
I had my first two “normal,” not-mock auction drafts over the past two evenings. The first was a fairly standard 12-team keeper league. I really liked your Tulo buy, that could make your team and it was good value. I wanted three solid, low risk and low injury risk bats, and I was happy ending up with Arenado, Betts, and Cain. Rounded it out with Lindor, Duffy, Kiermaier/Moreland/Schoop, with upside Soler and Buxton on the bench. Utility Wars draft was was fun. I thought Donaldson was a great value too, but it would of of left me with $20 for 10 guys. Depending how the auction went I was aiming to use platoons to fill the remaining 1 or 2 starting spots. I aimed to save a bit of money for my bench being that I could not add anyone during the season. I was in the #UtilityWars last night. Good article here especially the takeaway of having multiple strategies and being able to adapt to the flow and how your first bids/picks work out. I swung and missed at some guys Machado / Betts ,etc. My main strategy going in was planning on starting 7 or so guys. I may have overrated the daily aspect of the lineup changes but I wanted at least my top two bench guys to be solid and that’s what I got. It’s just my top end is a bit repressed. I figured over the long haul of a daily season it would be rewarding to have a good top end of my bench. Also high in batting order guys for more PA etc. Dind’t know what to do with prospects / rookies – buxton et. al. In the end I think I got a middling team, but you never know. But I queued up Josh Harrison and got him for a $1 in the second to last round. Yes I know its never good to have your best pick be a $1 …lol.
